social\u0103 \u015fi protec\u021bie a familiei<\/strong><\/p>\n<ol>\n<li><strong> INTRODUCERE<\/strong><\/li>\n<li>Regulamentul de organizare \u015fi func\u0163ionare a Direc\u0163iei asisten\u0163\u0103 social \u015fi protec\u0163ie a familiei (\u00een continuare \u2013 Regulament) reglementeaz\u0103 misiunea, func\u0163iile de baz\u0103, atribu\u0163iile \u015fi drepturile organului local de specialitate \u00een domeniul asisten\u021bei sociale \u0219i protec\u021biei familiei (\u00een continuare \u2013 organ local de specialitate), precum \u0219i modul de organizare \u015fi func\u0163ionare a acestuia.<br \/>\n2. Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este o subdiviziune structural\u0103 din subordinea autorit\u0103\u021bii reprezentative deliberative de nivelul al doilea \u0219i poate avea statut de\u00a0 direc\u021bie,\u00a0 \u00een conformitate cu Normele privind instituirea subdiviziunilor structurale ale autorit\u0103\u0163ilor publice, aprobate prin Hot\u0103r\u00eerea Guvernului nr. 1001 din 26 decembrie 2011.<br \/>\n3. Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este persoan\u0103 juridic\u0103, dispune de cont trezorerial, de \u015ftampil\u0103 cu imaginea Stemei de Stat \u015fi denumirea sa, de alte \u015ftampile \u015fi anteturi, de modelul stabilit.<\/li>\n<li>Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este organizat \u015fi func\u0163ioneaz\u0103 \u00een conformitate cu Constitu\u0163ia Republicii Moldova, legile \u00een vigoare, decretele Pre\u015fedintelui Republicii Moldova, hot\u0103r\u00eerile Parlamentului, ordonan\u0163ele, hot\u0103r\u00eerile \u015fi dispozi\u0163iile Guvernului, alte acte normative, tratate interna\u0163ionale la care Republica Moldova este parte, precum \u015fi cu prevederile prezentului Regulament.<br \/>\n5. Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei \u00ee\u015fi organizeaz\u0103 activitatea conform urm\u0103toarelor principii:<\/li>\n<\/ol>\n<p>1) accesibilitate \u015fi disponibilitate;<\/p>\n<p>2) informare;<\/p>\n<p>3) transparen\u021b\u0103;<\/p>\n<p>4) abordare individualizat\u0103 \u0219i multidisciplinar\u0103;<\/p>\n<p>5) parteneriate \u0219i colaborare;<\/p>\n<p>6) participarea beneficiarilor de asisten\u021b\u0103 social\u0103 \u00een procesul de luare a deciziilor;<\/p>\n<p>7) confiden\u0163ialitate;<\/p>\n<p>8) nondiscriminare \u0219i egalitate;<\/p>\n<p>9) solidaritate social\u0103;10) parteneriat social.<\/p>\n<ol start=\"6\">\n<li>Beneficiarii de asisten\u021b\u0103 social\u0103 la nivel teritorial s\u00eent:<\/li>\n<\/ol>\n<p>1) copiii \u00een situa\u021bie de risc \u0219i copiii separa\u021bi de p\u0103rin\u021bi;<\/p>\n<p>2) persoanele cu dizabilit\u0103\u021bi;<\/p>\n<p>3) persoanele \u00een etate;<\/p>\n<p>4) victimele violen\u021bei \u00een familie;<\/p>\n<p>5) victimele \u0219i poten\u021bialele victime ale traficului de fiin\u021be umane;<\/p>\n<p>6) persoanele \u0219i familiile defavorizate.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong> MISIUNEA, FUNC\u0162IILE DE BAZ\u0102,<br \/>\nATRIBU\u0162IILE \u015eI DREPTURILE ORGANULUI<br \/>\nLOCAL DE SPECIALITATE<\/strong><\/li>\n<li>Misiunea Direc\u0163iei asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei const\u0103 \u00een \u00eembun\u0103t\u0103\u021birea calit\u0103\u021bii vie\u021bii persoanelor \u0219i familiilor defavorizate, prin acordarea asisten\u021bei \u0219i suportului \u00een vederea prevenirii, diminu\u0103rii sau dep\u0103\u0219irii situa\u0163iei de dificultate \u0219i integrarea social\u0103 a acestora.<br \/>\n1. Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei are urm\u0103toarele func\u0163ii de baz\u0103:<br \/>\n1) implementarea \u00een unitatea administrativ-teritorial\u0103 respectiv\u0103 a politicii de stat \u00een domeniul asisten\u0163ei sociale \u0219i protec\u021biei familiei, \u00een func\u0163ie de necesit\u0103\u0163ile identificate;<br \/>\n2) acordarea suportului metodologic autorit\u0103\u021bilor administra\u021biei publice locale de nivelul \u00eent\u00eei, prestatorilor priva\u021bi \u0219i speciali\u0219tilor angaja\u021bi \u00een domeniul asisten\u021bei sociale \u0219i protec\u021biei familiei;<br \/>\n3) colaborarea cu autorit\u0103\u021bile, institu\u021biile \u0219i organiza\u021biile publice \u0219i private.<br \/>\n2. Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei are urm\u0103toarele atribu\u0163ii principale:<br \/>\n1) \u00een scopul implement\u0103rii \u00een unitatea administrativ-teritorial\u0103 respectiv\u0103 a politicii de stat \u00een domeniul asisten\u0163ei sociale \u0219i protec\u021biei familiei, \u00een func\u0163ie de necesit\u0103\u0163ile identificate:<br \/>\na) identific\u0103 problemele sociale \u00een raza administrativ-teritorial\u0103;<\/li>\n<li>b) generalizeaz\u0103 \u015fi sistematizeaz\u0103 informa\u0163ia privind asisten\u0163a social\u0103 acordat\u0103 \u015fi analizeaz\u0103 eficien\u0163a acesteia;<\/li>\n<li>c) elaboreaz\u0103 strategii de dezvoltare \u015fi prestare a asisten\u0163ei sociale, \u00een conformitate cu politica social\u0103 a statului;<\/li>\n<li>d) organizeaz\u0103 \u015fi acord\u0103 asisten\u0163\u0103 social\u0103 \u00een func\u0163ie de necesit\u0103\u0163ile identificate;<br \/>\ne) elaboreaz\u0103 \u0219i prezint\u0103 propuneri privind planificarea bugetului, fundamentat pe programe \u0219i performan\u021b\u0103, precum \u0219i pe rezultatele evalu\u0103rii necesit\u0103\u021bilor \u00een domeniul asisten\u021bei sociale \u0219i protec\u021biei familiei \u00een teritoriul administrat, precum \u0219i prezint\u0103 rapoarte privind realizarea lui, \u00een modul stabilit;<\/li>\n<li>f) \u00eendepline\u0219te func\u021biile de autoritate tutelar\u0103 teritorial\u0103 \u00een domeniul protec\u021biei copilului;<br \/>\ng) coordoneaz\u0103 procesul de cooperare intersectorial\u0103 pentru identificarea, evaluarea, referirea, asisten\u0163a \u015fi monitorizarea copiilor victime \u015fi poten\u0163iale victime ale violen\u0163ei, neglij\u0103rii, exploat\u0103rii \u015fi traficului, precum \u0219i stabile\u0219te parteneriate cu autorit\u0103\u021bile, institu\u021biile de resort \u00een domeniu;<br \/>\nh) asigur\u0103 implementarea standardelor generale de prestare a serviciilor;<br \/>\ni) asigur\u0103 gestionarea eficient\u0103 a aloca\u021biilor bugetare, patrimoniului \u0219i resurselor umane pentru dezvoltarea \u0219i acordarea asisten\u021bei sociale de calitate \u00een teritoriul administrat;<br \/>\nj) asigur\u0103 angajarea personalului conform legisla\u021biei;<\/li>\n<li>k) efectueaz\u0103 controlul intern al corectitudinii implement\u0103rii legisla\u021biei cu privire la presta\u021biile sociale pe care le stabile\u0219te \u0219i serviciile sociale pe care le presteaz\u0103;<\/li>\n<li>l) completeaz\u0103 sistemul informa\u0163ional \u00een domeniul asisten\u0163ei sociale cu date;<br \/>\nm) informeaz\u0103 popula\u0163ia despre situa\u0163ia \u00een domeniul asisten\u0163ei sociale \u0219i protec\u021biei familiei, despre modul de acordare a presta\u0163iilor \u015fi a serviciilor sociale \u0219i desf\u0103\u015foar\u0103 programe de informare-educare-comunicare \u015fi sensibilizare public\u0103;<\/li>\n<li>n) asigur\u0103 supervizarea personalului din sistemul de asisten\u0163\u0103 social\u0103;<\/li>\n<li>o) acord\u0103 suport administrativ managerilor serviciilor de asisten\u021b\u0103 social\u0103 \u00een scopul asigur\u0103rii sustenabilit\u0103\u021bii \u0219i eficien\u021bei serviciilor respective;<\/li>\n<li>p) prezint\u0103 propuneri Consiliului raional privind necesitatea dezvolt\u0103rii serviciilor de asisten\u0163\u0103 social\u0103 \u00een conformitate cu necesit\u0103\u021bile identificate \u0219i cu politica na\u0163ional\u0103 din domeniu;<br \/>\nq) prezint\u0103 informa\u021bii \u0219i date statistice la solicitarea Ministerului Muncii, Protec\u021biei Sociale \u0219i Familiei \u0219i altor autorit\u0103\u021bi, institu\u021bii, organiza\u021bii \u0219i altor entit\u0103\u021bi abilitate;<br \/>\nr) elaboreaz\u0103 rapoarte de activitate, pe care le prezint\u0103 Consiliului raional \u015fi le plaseaz\u0103 pe pagina web a acestuia;<\/li>\n<\/ol>\n<p>2) \u00een scopul acord\u0103rii suportului metodologic autorit\u0103\u021bilor administra\u021biei publice locale de nivelul \u00eent\u00eei, prestatorilor priva\u0163i \u0219i speciali\u0219tilor angaja\u021bi \u00een domeniul asisten\u021bei sociale \u0219i protec\u021biei familiei:<br \/>\na) sus\u0163ine autorit\u0103\u0163ile administra\u0163iei publice locale de nivelul \u00eent\u00eei \u015fi reprezentan\u0163ii societ\u0103\u0163ii civile \u00een activitatea de elaborare \u015fi implementare a programelor locale de asisten\u0163\u0103 social\u0103, precum \u015fi \u00een cea de monitorizare a realiz\u0103rii acestora;<\/p>\n<ol>\n<li>b) acord\u0103 suport metodologic institu\u0163iilor de asisten\u0163\u0103 social\u0103 din prim\u0103riile aflate \u00een raza unit\u0103\u0163ii administrativ-teritoriale de nivelul al doilea \u015fi \u00eenainteaz\u0103 propuneri \u00een vederea optimiz\u0103rii activit\u0103\u0163ii acestora;<br \/>\nc) ofer\u0103 asisten\u0163\u0103 metodologic\u0103 prestatorilor de servicii sociale;<\/li>\n<\/ol>\n<p>3) \u00een scopul colabor\u0103rii cu autorit\u0103\u021bile, institu\u021biile \u0219i organiza\u021biile publice \u0219i private:<br \/>\na) studiaz\u0103 experien\u021ba interna\u021bional\u0103 \u0219i bunele practici \u00een domeniul asisten\u021bei sociale \u0219i protec\u021biei familiei;<br \/>\nb) identific\u0103 parteneri de dezvoltare \u0219i coopereaz\u0103 cu ace\u015ftia;<\/p>\n<ol start=\"8\">\n<li>c) dezvolt\u0103 \u0219i implementeaz\u0103 parteneriate cu autorit\u0103\u021bile, institu\u021biile \u0219i organiza\u021biile publice \u0219i private;<br \/>\nd) \u00eencheie acorduri de cooperare \u00een domeniul asisten\u021bei sociale \u0219i protec\u021biei familiei.<br \/>\nDirec\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este \u00eenvestit cu urm\u0103toarele drepturi generale:<br \/>\n1) s\u0103 elaboreze, \u00een limitele competen\u021belor atribuite, instruc\u021biuni, indica\u021bii metodice, precum \u0219i alte acte privind domeniul s\u0103u de activitate;<\/li>\n<\/ol>\n<p>2) s\u0103 solicite de la autorit\u0103\u021bi, institu\u021bii \u0219i organiza\u021bii informa\u021bii necesare pentru activitate;<br \/>\n3) s\u0103 dezvolte \u015fi s\u0103 consolideze asisten\u0163a social\u0103 la nivelul unit\u0103\u0163ii administrativ-teritoriale conform necesit\u0103\u0163ilor sociale identificate;<\/p>\n<p>4) s\u0103 monitorizeze \u0219i s\u0103 evalueze calitatea serviciilor prestate de prestatorii publici \u0219i priva\u021bi din raza administrativ-teritorial\u0103 \u00een care activeaz\u0103;<\/p>\n<p>5) s\u0103 dezvolte parteneriate cu organiza\u021bii guvernamentale \u0219i neguvernamentale \u00een vederea implement\u0103rii politicilor din domeniul asisten\u021bei sociale;<br \/>\n6) s\u0103 formuleze recomand\u0103ri autorit\u0103\u021bilor administra\u021biei publice centrale \u0219i locale privind eficientizarea asisten\u021bei sociale;<\/p>\n<p>7) s\u0103 \u00eencadreze personalul direc\u021biei \u00een programe de formare ini\u021bial\u0103 \u0219i continu\u0103;<br \/>\n8) \u00a0s\u0103 \u00eenfiin\u0163eze consilii, comisii, grupuri de exper\u0163i \u015fi alte organe consultative pentru exercitarea atribu\u0163iilor \u00een sfera sa de competen\u0163\u0103;<\/p>\n<p>9) s\u0103 solicite, \u00een modul stabilit de cadrul normativ \u00een vigoare, de la alte autorit\u0103\u0163i locale, organiza\u0163ii \u015fi institu\u0163ii date statistice \u015fi informa\u0163ii viz\u00eend problemele din sfera sa de competen\u0163\u0103;<br \/>\n10) s\u0103 solicite Inspec\u021biei Sociale \u0219i Consiliului Na\u021bional pentru Acreditarea Prestatorilor de Servicii Sociale rapoartele de control \u0219i evaluare, cu specificarea \u00eenc\u0103lc\u0103rilor, neconformit\u0103\u021bilor constatate \u015fi cu recomand\u0103ri de eficientizare a activit\u0103\u0163ii.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>III. ORGANIZAREA ACTIVIT\u0102\u0162II ORGANULUI<br \/>\nLOCAL DE SPECIALITATE<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol start=\"9\">\n<li>Fiecare subdiviziune structural\u0103 a Direc\u0163iei asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei func\u0163ioneaz\u0103 \u00een baza unui regulament aprobat de \u0219eful organului local de specialitate.<br \/>\n10. Direc\u0163ia asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este condus de \u0219ef, numit conform legisla\u021biei de c\u0103tre Consiliul raional.<\/li>\n<li>\u015eeful Direc\u0163iei asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este responsabil de asigurarea calit\u0103\u021bii managementului, \u00een scopul \u00eendeplinirii func\u021biilor \u0219i atribu\u021biilor organului central de specialitate.<\/li>\n<li>\u015eeful Direc\u0163iei asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este \u015fi directorul executiv al Fondului local de sus\u0163inere social\u0103 a popula\u0163iei, care asigur\u0103 administrarea eficient\u0103 a mijloacelor financiare \u015fi valorilor materiale.<\/li>\n<li>\u00cen caz de absen\u0163\u0103 temporar\u0103 motivat\u0103, atribu\u0163iile \u015fefului organului local de specialitate s\u00eent exercitate de \u015feful adjunct sau, dup\u0103 caz, de un alt angajat al organului local de specialitate, desemnat prin ordinul \u015fefului.<\/li>\n<li>Personalul Direc\u0163iei asisten\u0163\u0103 social\u0103 \u015fi protec\u0163ie a familiei este constituit din func\u021bionari publici \u0219i personal contractual. Raporturile de serviciu ale func\u021bionarilor publici s\u00eent reglementate de prevederile Legii nr. 158-XVI din 4 iulie 2008 cu privire la func\u021bia public\u0103 \u0219i statutul
